The battle over a zinc factory coming to Cass County continues to heat up.

WSP has filed a lawsuit against more than 30 citizens in the county.

He joins us live to break down what is exactly going on.

Good evening meredith and to you all at home.

Wsp filed a lawsuit on july 22nd.

Attorney john schwarz is representing the citizens.

He says it started after many people questioned cass county's redevelopment commission.

He says the commission transferred $1.3 million dollars worth of real estate to wsp for only $10.00.

Which means the company purchasedmore8 cents an acre.

Many people began questioning the transaction.

33 citizens filed a suit asking the cass county courts to review the transaction.

That's when wsp brought a law suit against those citizens.

Schwarz says the company is claiming that this is damaging it by interfering with the title for the property.

Many of those people live in clymers which is a town about a mile away from wsp's construction site.

Schwarz says as of right now it's unsure what the company's goal is by filing this law suit.

"there's also unknown plaintiffs, they've sued unknown plaintiffs.

So i don't know if that includes all of the other thousands of other people that are opposed to this project or not.

It could be you know, i don't know are they going to bring in more people later on."

Right now as the lawsuit sits there's no judge to hear the case.

Schawrz says the judge originally assigned to the case recused them selves for unknown reasons.

Another judge was asked to take on the case and declined to do so.

They are now waiting to assign the case to another judge.

I am waiting to hear back from wsp and a representative from the county.

The case is still within its 30 day response period.
