For herkimer county family court judge.

After 31 additional ballots were found late on frida....one candidate has 'unofficially been declared the winner in th erepublican primary.

News channel 2's caitlin irla has more from both candidates.

Rose - "its been a shock for everybody, its not just about me, its not just about my opponent, its about the voting system as a whole, its about democracy as a whole and this issue needs to be addressed."

Candidate mark rose says he is not blaming the board of elections for making a mistake... but he is questioning the process.

Rose - "we're always going to have human error and we should expect human error and accept human error.

I think the process itself is very, very flawed here, i think we see it and the process has to be examined."

Candidate thad luke is unofficially declared the winner in the republican primary with 5 votes ahead of rose.

This after the board of elections found 31 uncounted ballots.

Luke - "i certainly believe it was an honest mistake, there's no one in that election office who's trying to fix this election."

"the board of elections has a process, and the process found the missed ballots and they had the fortitude to come forward and say to both candidates, we made a mistake, and here's the ballots and they called us in to count them."

The republican commissioner says there will be no recount... and that doesn't sit well with rose.

Rose - "i would like to see a recount and audit."

"its my understanding that a lawsuit would have to be brought, i don't want to have to bring a lawsuit the question is whether i should do that for my voters, they need to know."

As for luke... luke - "the fact is, they found their mistake, they have a process, they found it and they corrected it, hopefully they corrected it accurately, and i understand it's easy for me to take the position i am because i got more votes but that is how i feel."

According to the republican commissioner, votes will be certified by the end of the week.

If it ends up being official...luke would end up on the republican line in november as well as the independence line.

Rose would be on the conservative line.
