The herkimer county board of elections has told herkimer county family court judge candidate...mark rose....that they will not grant his request for a recount of ballots in his republican primary with thad luke.
Luke defeated rose by (five( votes after the candidates were at one point tied.
--then 31 additional absentee ballots were found.
In a statement to newschannel 2, rose says he is quote "not surprised they failed to act" and "this is another black eye given to the voters of herkimer county."
Rose did not indicate if he plans legal action to force a recount.
