Case Dismissed After Sheriff’s Courtroom Camera Tinkering Captures Juror and Attorney Notes

The camera work of a sheriff captures the courtroom notes of a juror and an attorney, causing a criminal case to be thrown out, reports The Seattle Times.????During the trial of a San Juan County, Washington man charged with a misdemeanor assault and trespassing, a judge working on an unrelated matter noticed that a normally stationary camera was moving.????It was then brought to the attention of the presiding judge Donald Eaton who sequestered the jury while he reviewed the footage.????The Seattle Times reports that the camera was being operated by county sheriff Ron Krebs.????In a sworn declaration to the court, Krebs said he was unaware that the camera could zoom and inadvertently positioned the lens in a way that it framed a juror’s notebook and documents from the defense.????Krebs also said during the declaration that he did not read anything.????After reviewing the footage and the situation, Judge Eaton dismissed all charges in the trial, citing government misconduct.????According to the Seattle Times, the footage has been placed under seal with an upcoming hearing in place to decide if the court should release the video.
